LIMITED WARRANTY

WINKLER CANVAS LTD. hereby warranty’s the canvas buildings and barns to be free of defects in material and workmanship for the warranty period stated below. The warranty applied only to the original customer and cannot be transferred. Warranty shall be effective only if and when:

1. The warranty card is completed within 60 days of the original purchase and returned to Winkler Canvas Ltd. Warranty is void if the warranty card is not returned to Winkler Canvas Ltd. within 60 days of purchase.
2. Winkler Canvas Ltd. is notified of the defect during the warranty period.

Any defects which are reported to Winkler Canvas Ltd. which apply to the warranty, are subject to Winkler Canvas’ assessment to repair or replace within a reasonable time period. Any components supplied under this warranty may be new, used, or rebuilt at the option of Winkler Canvas Ltd. Winker Canvas Ltd. does not cover the cost of removal, installation freight charges, insurance or duty that are incurred under this warranty. These costs are the responsibility of the customer.

This warranty contains the sole expressed warranty of Winkler Canvas Ltd. This warranty is made in lieu of any implied o expressed warranties of merchantability for a particular purpose.

Warranty Periods:

1. 5 year warranty on steel parts in main structure against manufacturing defects in material and workmanship.
2. 15 year pro-rated warranty on main cover tarp only. Color and 12oz clear options may be available upon request. Any building with fitted ends attached to the main cover such as Cabins, Run in Shelters or Calf Shelters, has a 5 year pro-rated warranty.
3. 3 year pro-rated warranty on all 6oz & 7.5oz tarps. This includes roof tarp only.
4. 2 year pro-rated warranty on all end tarps. This includes all 1/4 panels, solid ends, roll-up door and accutrack door tarps.
5. 6 year pro-rated warranty on 12oz Fire Retardant tarps.
6. Pro-Rated Warranty: If cover needs replacing, the customer/purchaser would be held responsible for the cost at 1/15 or 6.66% of the current list price per year.

Warranty Shall Not Apply to the Following:

1. Any damage occurring due to improper assembly.
2. Damage to our product or due to the failure of our product because of the lack of general maintenance. The customer is responsible for general maintenance, i.e. keeping the cover tight, or removing excess snow.
3. Neglect, misuse or abuse of the product.
4. Unauthorized repairs or alterations are done.
5. Damage or losses caused by natural or environmental conditions.
6. Damage or losses occurring during transport.
7. Damage due to the foundation design or installation.
8. Structures with only one end wall carry no frame or cover warranty if they do not have Winkler authorized ventilation.
9. Damage due to hanging apparatuses off of the inside of a building, without factory authorization.
10. Payment to the sales representative is not made in full within terms stated on contract.

The standard fabric used in the Winkler Canvas Ltd. products is not fire retardant. Winkler Canvas Ltd. will not be responsible of any damages, loss, or problems caused due to fire or zoning compliances with fire regulations.

This warranty shall not apply to any other products not manufactured by Winkler Canvas Ltd. No one is authorized to change or add to this warranty. Winkler Canvas Ltd. is not liable for any damages occurred during or as a result of installation of Winkler Canvas Ltd. products. In no event is Winkler Canvas Ltd. or an authorized dealer of Winkler Canvas Ltd. liable for any direct, indirect special, incidental or consequential damages. This includes loss of profits, loss of time, inconvenience, or the use or inability to use this product for any purposes whatsoever. The customer expressly releases and discharges Winkler Canvas Ltd. or any authorized dealer from all claims, demands, actions, suits, judgements, and executions for any actual, incidental, or consequential damages. This includes damages that the customer ever had, has now or may have created by erecting, assembly, use and operation of any Winkler Canvas Ltd. products.
